Effective Date of Rule: Thirty-one days after filing.
Purpose: Vancouver Lake: In 2024, the Washington state legislature passed HB 1226, which provided revisions to RCW 77.32.[0]10, thereby rescinding previous exemptions to fishing license requirements while fishing for smelt, crayfish, and common carp (i.e., a license is required to fish for these species following passage). However, HB 1226 provided an exception to the license requirement when fishing for common carp in Vancouver Lake. This exception was included based upon public comment received during legislative committee hearings. While the Washington legislature provided a clear exception to the license requirement for Vancouver Lake, questions about the implementation and enforcement of the rule have since arisen. Confusion around the license requirement originates in WAC that defines the fishing area for Vancouver Lake, which is included with a complex of state waters, defined as: "Vancouver Lake and all other waters west of Burlington-Northern railroad from Columbia River drawbridge near Vancouver downstream to Lewis River." Specifically, the Washington department of fish and wildlife (WDFW) enforcement staff are unclear where a fishing license would not be required in this area to fish for common carp, due to the ambiguity of the definition. Further, some anglers contend that the Vancouver Lake definition extends to all waters covered by the definition (Lake River in particular), which WDFW enforcement and department staff dispute. Amendments to WAC 220-312-030 (southwest) and WAC 220-220-160 (two-pole endorsement) are needed to provide clarity in the rules and alignment with RCW 77.32.[0]10.
Cle Elum River: The United States Bureau of Reclamation, in collaboration with Yakama Nation, WDFW, and other basin partners, is currently constructing an adult fish collection (AFC) facility at the base of Cle Elum Dam. Completion of the AFC will provide upstream passage for returning anadromous species as well as resident species that are entrained by the dam outlet and are attempting to return to the reservoir or its tributaries. Consistent with our statewide general rule (WAC 220-310-030(1)) to restrict fishing below dams, fishways, and other man-made barriers, a closure of the area downstream of the AFC is warranted to limit impacts to fish attempting to use the facility. Existing regulations allow fishing year-round under selective gear rules up to the base of Cle Elum Dam. Region 3 fish management is proposing to close a portion of the Cle Elum River downstream of Cle Elum Dam. This area is currently closed under an emergency regulation to prevent impacts associated with construction and dewatering of the river during the project work window. The proposed permanent closure would extend from the downstream face of the dam to the "Green Bridge" located approximately 2,000 feet below the AFC. While this is a greater distance than the 400-foot statewide general rule, use of the bridge as a landmark is supported by Region 3 enforcement program as an easily identifiable compliance point. Additionally, there is limited recreational angling use of this stretch of the Cle Elum River except for the stilling basin immediately below the dam.
Eastside Lakes: WDFW received a petition from the public to extend the fishing season from the fourth Saturday in April to September 30 to the fourth Saturday in April to October 31 on seven lakes in eastern Washington (WDFW administrative Region 1). The list of lakes in the petition included Badger, Deer (Lincoln County (Co.), also known as Deer Springs), Fan, Fish (Spokane Co.), Fishtrap, West Medical, and Williams (Spokane Co.). This petition proposed extending the fishing season for each of these lakes by one month. The WDFW director chose to deny the petition but instructed staff to initiate rule making to extend the fishing season to October 31 annually on five of the seven lakes proposed in the petition. Two of the lakes were removed from consideration due to landowner or public use conflicts. The five lakes put forth for rule making were Badger, Fan, Fishtrap, West Medical, and Williams (Spokane Co.). After taking public comments during the rule-making process, additional opposition from Fishtrap Lake Resort was recorded. Because of the resort's proximity to WDFW's public access and resort owners' concerns around increased operating cost, public trespass, and increased liability, Fishtrap Lake will be excluded from the rule making, which will differ from what was reflected in the CR-102.
