WSR 26-01-032
WITHDRAWAL OF PROPOSED RULES
DEPARTMENT OF HEALTH
[Filed December 8, 2025, 11:02 a.m.]
This memo serves as notice that the Washington medical commission (commission) is withdrawing the CR-102 for office-based surgery rules for allopathic physicians and the use of nitrous oxide, which was filed June 30, 2025, under WSR 25-14-080.
The commission proposed a new section WAC 246-919-603 Use of nitrous oxide in office-based settings, and proposed changes to WAC 246-919-601 Safe and effective analgesia and anesthesia administration in office-based surgical settings.
The commission is withdrawing this CR-102 because at the August 22, 2025, public rule hearing, the commission voted to reconsider the proposal rather than adopting the rule. The commission wishes to further develop the rule with interested parties.
At the November 20, 2025, business meeting, the commission voted to withdraw WSR 25-14-080 and will file a new CR-102 under the preproposal statement of inquiry filed under WSR 24-11-104.
