PREPROPOSAL STATEMENT OF INQUIRY
WASHINGTON STATE LOTTERY

Subject of Possible Rule Making: Washington's lottery (lottery) is considering revisions to WAC 315-10-025 Cost to purchase an instant game ticket. Lottery is contemplating whether to increase the maximum price of an instant (scratch-off) game ticket.

67.70.040(1).
Reasons Why Rules on this Subject may be Needed and What They Might Accomplish: Pursuant to RCW
67.70.040 (1)(b), the lottery commission must set "the price, or prices, of tickets or shares in the lottery." Since 2015, WAC 315-10-025 has set the price range for scratch tickets as not less than $1 and not more than $30. Lottery would like to explore whether a higher price point would be advantageous to the state and/or desired by players.
Process for Developing New Rule: Lottery will use a collaborative rule-making process to develop the proposed rules. Lottery will post draft rules on its website and notify interested parties of the opportunity to provide informal comments. Staff will valuate informal comments prior to proposing the rule for adoption. Formal comments will be taken in writing during the formal comment period and in person at the public hearing.
