PREPROPOSAL STATEMENT OF INQUIRY

Subject of Possible Rule Making: Implementation of section 1307 of ESSB 5801 (2025), Impounded vehicles owned by indigent persons.
Statutes Authorizing the Agency to Adopt Rules on this Subject: Chapter 46.55 RCW, Towing and impoundment; RCW 46.01.110 Rule-making authority; and ESSB 5801, chapter 417, Laws of 2025.
Reasons Why Rules on this Subject may be Needed and What They Might Accomplish: ESSB 5801 from the 2025 legislative session directs the department of licensing to create a program through rule that compensates registered tow truck operators for vehicle impounds where the vehicle is owned by an indigent individual. The proposed rule making will establish program processes, requirements, rates and caps for compensation, and other elements necessary for operation and public participation in the program.
