PREPROPOSAL STATEMENT OF INQUIRY

Subject of Possible Rule Making: Implementing the law enforcement officers' and firefighters' retirement system (LEOFF) Plan 1 termination and restatement bill and incorporating certain federal requirements.
Statutes Authorizing the Agency to Adopt Rules on this Subject: RCW 41.50.050, chapter 261, Laws of 2026; SECURE Act 2.0 of 2022 (P.L. 117-328); SECURE Act of 2019 (P.L. 116-94); and PATH Act of 2015 (P.L. 114-113).
Reasons Why Rules on this Subject may be Needed and What They Might Accomplish: The department of retirement systems (DRS) is undertaking rule making to implement chapter 261, Laws of 2026, the LEOFF Plan 1 termination and restatement bill, and to expressly incorporate certain federal requirements from the SECURE 2.0 Act and the PATH Act into its general rules.
