SUBJECT: Department of Licensing, Rule Review Plan
I am pleased to present the Department of Licensing's plan to review all
agency rules over the next four years. Licensing is an agency which
continues to embrace regulatory improvement. This is evidenced by the
agency's compliance with RCW 19.85.050 (Regulatory Fairness Act) where
all rules were reviewed over a ten year time period (1982 - 1992).
All agency programs are committed to review all rules, not just those
that may be controversial or may have been the source of complaints. Our
review narrative document, attached, has two sections:
The division of all rules into logical topic areas and the
identification of the stakeholders who were contacted to help
develop the review plan.
The Rules Review Plan, with time tables and methods by which
interested parties can participate in the review process.
We plan to continue the review of our rules using these same methods
beyond the initial four year period. Additionally, all new rules will
adhere to the principles outlined in Executive Order 97-02.

eleven subject categories, identified stakeholders for each category, and
invited stakeholder participation in developing a review plan for each
subject category. The review plan has been developed in coordination

BUSINESS AND PROFESSIONS DIVISION
Approach: The Business and Professions Division will conduct a four-year
systematic review of approximately 500 rules of the 26 business and
licensing programs. Responsibility for conducting the rules review will
be with the program administrators. The rules will be reviewed according
to the criteria outlined in Executive Order 97-02 with the intent of
determining whether each rule should be retained, repealed, or amended.
A high level of public participation in the reviews will be solicited
from various stakeholder groups, boards and commissions. Selected
methods of solicitation of involvement shall include but are not limited
to:
1. Direct contacts and personal communications with industry
associations, professional boards and commissions.
Associations will be solicited to carry rule-making notices in
newsletters and announcements at association meetings and
gatherings.
2. Direct contacts with licensees through solicitations on
license and registration renewal notices requesting individual
participation in rule-making.
3. News media coverage, specifically on public sensitive issues
and rules having significant impact on individuals or
businesses.
4. Aggressively searching for representative from social
societies and occupational groups to participate in the
Division's rule-making.
Stakeholder groups have been consulted in the development of the Review
Plan. Further public participation in the reviews will be achieved
through board and commission meetings, focus groups, surveys, and written
testimony. Research will be derived from AAG analyses, available data,
economic analyses, and historical records and files. Documentation of
the research and applied criteria will be placed in the official rules
files held in each program area.
Rules which do not meet the criteria will be repealed semi-annually
through the expedited rules repeal process or amended according to all
requirements of the Administrative Procedures Act and the Regulatory
Reform Act.
Rules will be reviewed according to the schedule below. Every fourth
year from the end of the last review process, the Department of Licensing
will reopen the rule for public comment. The comments received from the
public will determine the need for amendments or repeal.

Real Estate Program staff presented an overview of Governor Locke's
Executive Order to the members of the Washington Real Estate Commission

significant rules was discussed, and the Commission asked the program
staff to develop a "preliminary" rule review plan for their
consideration. Individual Commission members were polled by telephone
to solicit their comments on the rule review plan. The "preliminary"
rule review plan was also distributed to the following industry groups:
approximately 200 real estate licensees and other interested parties on
the Real Estate Commission Mailing List, members of the Washington
Chapter of the Real Estate Educators Association, staff of the Washington
Association of Realtors, and 60 Eastern Washington Brokers during a
series of four focus group sessions.

business owner representing the limousine industry. He felt that it was

Approach: Administrative Services has divided its administrative rules
into three subject categories, identified stakeholders for each category,
and will invite stakeholder participation in the review process.
Method by Which the Division Will Determine the Rule Meets Review
Criteria: The Administrative Services Division, together with public
participation, will review the rules to ensure overall compliance with
the following criteria:
Is the rule necessary?
Is the rule effective and efficient?
Is the rule easy to understand?
Is the rule following the intent and legal authority of the
law?
Is the rule in coordination with other similar laws?
Is the rule cost effective?
Is the rule fair to all those required to comply?
Review of a rule will determine if the rule should remain, be amended,
or be repealed.
Method of Public Participation and how Interested Parties May Participate
in Review: The Administrative Services Division will use various methods
of public participation in the review of its rules. These methods may
include public meetings, requests for written comments through
stakeholder lists, and communications through press releases, Internet
postings, and newsletters.
Interested parties may participate in the rule review process by
submitting their name and correspondence address to the Division by mail,
phone, facsimile transmission, or by e-mail.
Process for On-Going Review of Rules after Initial Four Year Review
Period: The Division will repeat the above process, using similar
methods, every four years.
