PREPROPOSAL STATEMENT OF INQUIRY

SUPERINTENDENT OF

PUBLIC INSTRUCTION

Subject of Possible Rule Making: Chapter 392-115 WAC, Finance--Audit resolution process.

Statutes Authorizing the Agency to Adopt Rules on this Subject: SSB 5394, RCW 28A.300.070.

Reasons Why Rules on this Subject may be Needed and What They Might Accomplish: To implement SSB 5394 which gives the superintendent authority to resolve all audit findings (monetary or nonmonetary) involving state funds and recover such funds or make apportionment adjustments as necessary.

Other Federal and State Agencies that Regulate this Subject and the Process Coordinating the Rule with These Agencies: No other federal or state agencies regulate the Office of the Superintendent of Public Instruction in regards to audit oversight or resolution.

Process for Developing New Rule: Early solicitation of public comments and recommendations respecting new, amended or repealed rules, and consideration of the comments and recommendations in the course of drafting rules.
